Methodology

Built to withstand Daubert

Opinions rest on methods that are testable, peer-reviewed, standards-based, and reproducible from the underlying data, satisfying the reliability factors of Daubert v. Merrell Dow Pharmaceuticals and Federal Rule of Evidence 702.

Testability

Signal-control algorithms developed by Dr. Abbas were tested in hardware-in-the-loop and cabinet-in-the-loop simulation before deployment, then validated in field installations under FHWA, VCTIR, and TxDOT projects.

Peer review

Methods are documented in Transportation Research Record, IEEE Transactions on Intelligent Transportation Systems, the ASCE Journal of Transportation Engineering, and in FHWA and TxDOT final reports.

Known error rate

Field and simulation evaluations produced quantified performance metrics with documented calibration and validation, including confidence intervals on reductions in dilemma-zone trapping, delay, and stops.

Standards

Analyses conform to the MUTCD, Highway Capacity Manual, Highway Safety Manual, AASHTO design guidance, and FHWA technical guidance where applicable.

General acceptance

The methods are those used in practice by state DOTs, FHWA, and the transportation-engineering research community, as reflected in agency guidance, NCHRP reports, and TRB committee work.

Reproducibility

Workflows for event-log decoding, timing-plan reconstruction, microsimulation calibration, and contributing-factor analysis are documented so another engineer can reproduce them from the same data.

How an engagement proceeds

Engagements are contracted and billed through Intelligent Transportation Concepts, LLC. The fee schedule and engagement agreement are provided to counsel on request.

  1. Conflict check

    Counsel provides the caption, parties, and related entities. No substantive information is exchanged until the check clears.

  2. Engagement agreement and retainer

    Scope, fee schedule, and confidentiality terms are set in a signed agreement. A retainer is applied against fees as they accrue.

  3. Review and analysis

    Document, data, and site review; controller event-log decoding; simulation or field work as the matter requires.

  4. Report or declaration

    A Rule 26-compliant report or declaration stating opinions, bases, and the materials considered.

  5. Deposition and trial

    Preparation with counsel and testimony at deposition, hearing, or trial. Reserved dates are held exclusively for the retaining party.

Hourly billing in quarter-hour increments. Fees are never contingent on the outcome of a matter or on the opinions rendered.
The same rates apply to plaintiffs, defendants, petitioners, respondents, and government or regulatory bodies.
Monthly itemized statements showing time, tasks, expenses, and the remaining retainer balance. Unused retainer is refunded.
Non-public information about a matter, including the fact and terms of the engagement, is kept confidential. Work in support of litigation is prepared as attorney work product.
